Terms of Service

Please read these terms carefully before using our platform.

1. Acceptance of Terms

By creating an account or using SmartReview ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

SmartReview provides a review management platform that helps local businesses collect customer feedback, route reviews intelligently, and grow their online reputation. Features include smart review routing, email sequences, QR code generation, and social media growth tools.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited emails or spam to customers who have not given consent.
  • Create fake or fraudulent reviews on Google or any other platform.
  • Collect customer data without appropriate consent and legal basis.
  • Violate Google's review policies or any other third-party platform's terms.
  • Upload malicious content, viruses or harmful code.
  • Misrepresent your identity or business.
  • Use the Service for any unlawful purpose.

5. Review Routing Compliance

Our smart routing system routes happy customers to Google and unhappy ones to private feedback. This is fully compliant with Google's review policies as we collect genuine feedback from all customers and never ask for a specific rating. You must not use the Service in a way that violates Google's review policies, including purchasing reviews or incentivising specific star ratings.

6. Customer Data Responsibilities

When you upload customer data (email addresses, names) to the Service:

  • You confirm you have a legitimate basis to contact those customers.
  • You are responsible for compliance with GDPR, CAN-SPAM, and applicable data protection laws.
  • You must honour any unsubscribe requests promptly.
  • You must not upload data obtained through illegal means.

7. Payment Terms

  • Paid plans are billed monthly or annually in advance.
  • All fees are non-refundable unless required by law.
  • We reserve the right to change pricing with 30 days notice.
  • Failure to pay may result in suspension of your account.
  • Prices are exclusive of applicable taxes.

8. Free Trial

Where a free trial is offered, it is limited to one trial per business. We reserve the right to terminate trials that appear to be abused or operated by the same entity multiple times.

9. Intellectual Property

The Service, including all software, design, content and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute or create derivative works without our written permission.

You retain ownership of your business data and customer data uploaded to the Service.

10. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that causes temporary downtime. We are not liable for losses caused by service unavailability.

11. Limitation of Liability

To the maximum extent permitted by law, SmartReview shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of revenue, loss of customers, or reputational damage.

Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Termination

You may cancel your account at any time from your dashboard settings. We may terminate or suspend your account immediately if you breach these terms. Upon termination, your data will be retained for 30 days and then deleted.

13. Changes to Terms

We may update these terms from time to time. We will notify you by email of significant changes with at least 14 days notice. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
